At the end of the 20th century, human rights have frequently been qualified as the "common heritage" or the "common language" or humanity. They do not belong to the domestic jurisdiction of states and are internationally protected, creating a body of universal standards and values at the service of human dignity, equality and non-discrimination, and human freedoms. Since the adoption of the United Nations Charter in 1945 and the Universal Declaration of Human Rights in 1948, a comprehensive international human rights law embracing many international instruments has been created. An analysis and presentation of the conceptual framework and adopted human rights standards is the main objective of this volume. The book is divided into four parts. The first deals with the concept of human rights, presenting the evolution and expansion of the concept and its philosophical formulations and theoretical reflection on the nature and sources of human rights. International standards are grouped, first, from the point of view of categories of human rights: civil, political, economic, social and cultural, and then in relation to the protection of certain categories of vulnerable persons.
The second and third parts are intended to be read in conjunction with the first vollume of this manual, "Human Rights: New Dimensions and Challenges", because the human rights presented therein, such as the right to development, are not repeated in this volume. The presentation of international human rights law in this volume is based on the fundamental assumption proclaimed by the Vienna Declaration and Programme of Action (June 1993). The final section discusses the relationship between human rights and humanitarian law. The existence of armed conflicts, both international and internal, does not in any way liberate belligerents from respect for human rights. Respect and knowledge of humanitarian standards are a guarantee for the observance of human rights. The volume is not intended to give a comprehensive picture of the implentation and violations of human rights in the world. Instead it raises many questions linked with the observance of adopted standards and discusses the main obstacles to their full implementation, as well as the causes of their violation.
