In the equity share purchase, the parties co-own the property. They are called Investor and Occupier. The Investor is the one who provides the down payment cash. When the real estate market is good, it should be easy to find an Investor. When the real estate market is less than good your best Investor is the seller of a property. Always, your most willing Investor is a family member. The Equity Share transaction puts the Investor and Occupier on title, backed by a deed of trust for the Investor to foreclose in case the Occupier defaults. This protection is essential for the Investor. In the 70's and 80's when Equity Sharing first became popular, the Investor did not have this protection and sometimes lost. Our other protection for both Investor and Occupier is automatic continuance of ownership if a certain appreciation is not met.
