反對對立法環節進行司法審查的主題絕對值得同情,辯護立法尊嚴的努力也絕對值得肯定,但核心人物的選取稍顯尷尬,最拿手看起來也最具樞紐意義的洛剋既不是立法尊嚴的擁躉,也未能對規範性進行辯護,立法生活在一層層的同意-最低限度共識的包裹下,反倒顯得愈發缺乏內在價值。
評分與law and disagreement同時齣版。這本是一種思想史的考察(亞裏士多德、洛剋、康德這三位通常不視為立法理論傢),可以當做LD的注腳。
