（哈特，法律實證主義巨擘，這本依舊是選讀。）Legal Positivism的要旨在於法之為法應當暫不進行道德判斷，法為IS而非OUGHT。法律本身存在著由官方認可的基本規則，並是依此形成的一種規則體係。

第三版，本來隻打算讀Green的序言加postscript，但最後又把全書重讀瞭一次。哈特通過對日常法律現象的考察，批評瞭奧斯汀和凱爾森以降的法律實證主義模型，並提齣一個既能更好解釋法律現象、又能大緻保留實證主義一些經典theses的模型框架。哈特的框架當然並未很細緻，在構成social rule的必要條件，rule of recognition是否能包括道德原則或評價性條件等問題依然有待後人解決。但哈特對德沃金的迴應我覺得大緻上是到點的。這次最感興趣的是哈特的方法論，即他反復強調的descriptive jurisprudence究竟是如何研究及其意義。一方麵，能看到哈特和韋伯式的社會學研究的有類似之處，但法律畢竟是帶有規範性的規則，價值中立的方法論究竟能走多遠？

H.L.A.哈特（1907-1992），前牛津大學法理學講度教授，英國法理學傢，新分析實證主義法學創始人，20世紀英語世界最為偉大的法學傢。哈特以其實證主義的姿態、自由主義的立場、分析主義的旗幟以及道德哲學傢的情懷，構建瞭一個龐大而自洽的法理學體係。在其之前，20世紀中期的（英語）政治哲學瀕於消亡，法律哲學也奄奄一息；而在他之後，卻是分析法學大行其道，法理學界眾神喧嘩。所以，當代英美著名法學傢科爾曼、拉茲等人認為是哈特拯救瞭西方（英美）的政治哲學和法哲學。哈特梳理和加強瞭法律哲學與道德以及政治哲學之間的聯係，法哲學與精神哲學和邏輯哲學的聯係－－在此任何一個主題上，他都做齣瞭嚴肅的貢獻。而且，沿循邊沁的腳步，在道德哲學與政治哲學領域裏，他是自由主義傳統最強大的代言人。

他的作品包括：《法律的概念》（1961，1994）；《法律、自由與道德》（1968）；《懲罰與責任》（1968）；《法律中的因果關係》（與A.M.奧諾裏閤作，第二版，1985）以及《論邊沁》（1982）。
