评分其实读的不是这个版本，但内容没区别就权且这么记录了。一部经典的法律史作品，主要讲两个问题一条主线:一是法律是在不断演变的，二是美国法律的演进是工具主义的，即为了美国的经济发展而服务。所以主线就是经济发展。说说我以为的不足:不是说经济发展作为演进的动力有什么问题，而是觉得这种单一线性关系不足以支撑法律史的进程。本书暗示了从经济发展到法律制定的单向关系以及，暗示了法律的演变始终落后于经济发展的脚步，这可能不是那么太符合历史甚至，可以说是隐含了用先后顺序部分代替因果关系的问题。而最新的制度研究其实也说明了诸如法律这样的制度和经济之间的关系是复杂的，可能更类似福格尔说的协同演化。
评分法律史研究的经典叙述模式，案例材料证明非常高密度和有说服力，提炼到法律和社会互动的高度，不单单是论制度本身，且开头结尾都有思想史的点题和升华。是高老师上专题文献时候的精读推荐本
评分比较传统的马克思主义史学的力作。我觉得所有民法甚至法学专业的人都应该读他，中文翻译非常一般，没校对出的错误也不少，虽没差到无法读的地步。霍爷有力的证明了美国法是如何被重塑以服务与新兴的资本主义，法官通过对私法重塑将成本分配给了社会上沉默的弱势，对动了新型资本主义的发展。
评分第一次接触法律史，非常有启发。
