挺不錯的私法史書籍，在發展的洪流中，法律如何發展。在我們不斷仰望民法典的今天，應該看看法律如何變遷。

第一次接觸法律史，非常有啓發。

其實讀的不是這個版本，但內容沒區彆就權且這麼記錄瞭。一部經典的法律史作品，主要講兩個問題一條主綫:一是法律是在不斷演變的，二是美國法律的演進是工具主義的，即為瞭美國的經濟發展而服務。所以主綫就是經濟發展。說說我以為的不足:不是說經濟發展作為演進的動力有什麼問題，而是覺得這種單一綫性關係不足以支撐法律史的進程。本書暗示瞭從經濟發展到法律製定的單嚮關係以及，暗示瞭法律的演變始終落後於經濟發展的腳步，這可能不是那麼太符閤曆史甚至，可以說是隱含瞭用先後順序部分代替因果關係的問題。而最新的製度研究其實也說明瞭諸如法律這樣的製度和經濟之間的關係是復雜的，可能更類似福格爾說的協同演化。

比較傳統的馬剋思主義史學的力作。我覺得所有民法甚至法學專業的人都應該讀他，中文翻譯非常一般，沒校對齣的錯誤也不少，雖沒差到無法讀的地步。霍爺有力的證明瞭美國法是如何被重塑以服務與新興的資本主義，法官通過對私法重塑將成本分配給瞭社會上沉默的弱勢，對動瞭新型資本主義的發展。
